FIM interface with EFT/POS terminals

Published in F.E.K. the decision A.1190/30.12.2022 amending decision A.1098/13-7-2022, which has as its subject: "Definition of technical specifications (communication protocol) and other functions, for the interconnection between Tax Electronic Mechanisms and EFT/POS terminals. Implementation of the principle "collection by card - mandatory issuance of a receipt by F.H.I.M."

Articles 3,4 and the Appendix of A.1098/13-7-2022 of the AADE Governor's decision A.1098/13-7-2022 are amended as follows:

Article 3

Retail Issuer Systems and Payment Card Acceptance Terminals (EFTPOS) Interconnection Protocol.

3.1. The EFTPOS Interface Protocol is described in the annex.

3.2. EFTPOS implementing this protocol are not allowed to operate stand-alone for debit transactions, i.e. card payments. In particular, it is not allowed to type in the payment amount in the case of debit transactions. In the special case where an accounting item (retail transaction receipt or invoice) has already been issued by the FIM for which a later payment is expected by EFTPOS, this accounting item is pre-loaded to the EFTPOS by the FIM. EFTPOS is then able to carry out one or more transactions, for each of the preloaded accounting elements, without, however, the algebraic sum of these transactions exceeding the total amount of the particular preloaded accounting element. EFTPOS also has the ability, with proper handling, to pay off more than one pre-loaded account with a single debit transaction, always respecting the no-key-in amount restriction. In all cases, however, it is allowed to set the number of installments in EFTPOS. EFTPOS are allowed to carry out credit transactions autonomously, i.e. card refunds, which are documented by the corresponding issued sales documents. EFTPOS perform pre-authorizations autonomously.

3.3. In case of a temporary failure of the FIM, or in case of a temporary failure of the EFTPOS-FIM interface "infrastructure failure", the owner of the FIM declares the temporary failure in the "esend" FIM Information System. EFTPOS communicates electronically with the "esend" EMS, which instructs it to activate the ability to enter the payment amount in the case of debit transactions. The activation of the EFTPOS keying feature due to an infrastructure failure to enter a payment amount in the case of debit transactions has a maximum duration of twelve (12) hours and is allowed a maximum of once every three months.

The release of the EFTPOS keyboard due to FIM failure for entering a payment amount; in the case of debit transactions, for all liable businesses, has a maximum duration of twenty; four (24) hours. For businesses operating in villages with a population of up to five hundred (500) inhabitants and islands with less than three thousand one hundred (3,100) inhabitants, the release of the EFTPOS keyboard has a maximum duration of five (5) days, unless it is a tourist places.

In any case, the obligation to transmit this data to the myDATA digital platform is not waived, in accordance with the provisions of the joint decision of the Minister of Finance and the Governor of AADE under items A.1138/2020 (B' 2470).

3.4. This protocol does not apply to EFTPOS, if the company does not have an obligation to use FIM and does not use FIM. It is also allowed to process EFTPOS transactions without a FIM connection, at petrol stations or taxis, where the FIM is driven by a fuel pump or taxi meter respectively. In these cases, this protocol does not apply.
